RE: The tariff classification of molded glass bricks and pieces from China.

Dear Ms. Vourvoulis:

In your letter dated November 29, 2016, you requested a tariff classification ruling.

The merchandise under consideration is referred to as glass bricks and glass pieces. From the information you provided, the glass bricks will be imported in two different sizes, 9 inches long by 6 inches wide by 1.75 inches thick, and 4.5 inches long by 6 inches wide by 1.75 inches thick. They are made of clear molded glass. After importation, these bricks will be installed into steel grids, which are bolted together and then permanently bolted to the floor and ceiling of the lobby reception area of a hotel to create a glass brick wall.

The glass pieces measure approximately 4.75 inches long by 7.75 inches wide by between .5 inches and 1 inch thick. They are made of clear molded glass. After importation, the pieces will be attached to metal frames by means of brackets. These frames will then be permanently bolted to the floor and ceiling of the lobby reception area of a hotel to divide the room.

The applicable subheading for the molded glass bricks will be 7016.90.1010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Paving blocks, slabs, bricks, squares, tiles and other articles of pressed or molded glass, whether or not wired, of a kind used for building or construction purposes…: Other: Paving blocks, slabs, bricks, squares, tiles and other articles of pressed or molded glass: Bricks or blocks.” The general rate of duty will be 8 percent ad valorem.

The applicable subheading for the molded glass pieces will be 7016.90.1050, HTSUS, which provides for “Paving blocks, slabs, bricks, squares, tiles and other articles of pressed or molded glass, whether or not wired, of a kind used for building or construction purposes…: Other: Paving blocks, slabs, bricks, squares, tiles and other articles of pressed or molded glass: Other.” The general rate of duty will be 8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
